
Stephen C. Steinberg is a Partner of Bartko Pavia LLP and Co-Chair of the Intellectual Property Practice. Steve is a trial lawyer, specializing in intellectual property, privacy, and complex business litigation, including claims for trademark and copyright infringement, theft of trade secrets, privacy issues related to data sharing online and data breaches, claims between founders of technology startups, and other complex business disputes in both federal and state courts. He has represented clients in numerous trials, where he has won victories for both plaintiffs and defendants. Steve is also highly regarded for his service to the legal community in the Bay Area and beyond, as he currently serves as Secretary of the Northern California chapter of the Association of Business Trial Lawyers, and previously served as Chair of an American Bar Association committee and President (youngest ever) of the Contra Costa County Bar Association.
In the field of IP litigation, Steve has litigated trademark and copyright cases for video game, e-commerce, consumer product, and specialty food companies, as well as a leading font designer. He has litigated patent cases concerning mobile phone accessories, web browsers, light emitting diodes (LEDs), networking technologies such as Power-over-Ethernet and WiFi, and power conversion technologies. Steve has also represented numerous technology companies in prosecuting and defending against claims for theft of trade secrets, breach of fiduciary duties, interference, and related claims, as well as cases for breach of contract against suppliers and disputes arising out of mergers and acquisitions.
In the field of privacy litigation, Steve has defended multiple healthcare systems against class actions related to website technologies, such as analytics, pixels, and cookies, and related to data breaches, including claims involving PHI under HIPAA, “medical information” under CMIA, wiretapping under the California Invasion of Privacy Act (CIPA), as well as other statutory, common law and constitutional claims.
Steve has also handled numerous cases involving disputes between co-founders of startups and between founders and their former companies.
Before joining Bartko Pavia, Steve was Counsel at Vasquez, Benisek and Lindgren / Morgan Miller Blair and an associate at Morrison & Foerster LLP, where he handled a wide array of business disputes.
While in law school, Steve served as an extern for the Honorable Chief Judge Marilyn Hall Patel of the U.S. District Court for the Northern District of California in San Francisco, and as an extern for the Honorable Chief Justice Geoffrey Ma of the Hong Kong High Court in Hong Kong.

February 19, 2020 – Bartko scored the highest Intellectual Property and Trade Secrets victory in California in 2019 and was ranked Number 2 overall in the California Daily Journal’s Top Verdicts (PDF) by Dollar in California for 2019. In May of 2019, Bartko secured an $845,114,000.00 victory in Santa Clara County Superior Court. Patrick M. Ryan is quoted as saying: “One thing that’s always a challenge in a trade secret or intellectual property trial is the need to make complex technology simple and easy to understand for the jury.” Also, Patrick stated: “Over the course of the trial, we really went through the technology and explained how it worked and why it was important, and the jury really got it.”The trial team from Bartko was led by Patrick M. Bartko Firm Obtains $845,114,000 Judgment for ASML Against XTAL, Inc.
On Friday, May 3, 2019, a Santa Clara County Superior Court judge entered judgment in favor of ASML US, LLC and against XTAL, Inc. in the case ASML US, Inc. v. XTAL, Inc., Santa Clara Superior Court Case No. 16-CV-295051, in the amount of $845,114,000.00. The entry of judgment finalizes the verdict returned by the jury on November 28, 2018, in favor of ASML on all five claims pleaded by ASML in its Third Amended Complaint against XTAL for theft of trade secrets, inducing former employees to breach their contracts with ASML, aiding and abetting former employees to breach their fiduciary duty of loyalty to ASML, and multiple violations of California’s Computer Data Access and Fraud Act (Cal. Penal Code Section 502). The jury also found that XTAL’s conduct as to all counts was malicious, entitling ASML to an award of punitive damages on all counts and attorneys’ fees on its Penal Code and trade secret claims. ASML’s trial team from Bartko was led by Patrick M. Ryan, and he and Stephen Steinberg, Sean McTigue, and Brian Smith examined witnesses and gave argument during the trial, supported by attorneys Andrew Winetroub, Joseph Fraresso, Alden Lee, Rishi Gupta, and Chad DeVeaux. Patrick Ryan, Sean McTigue, and Richard Lapping of Trodella & Lapping LLP represented ASML’s interests in XTAL’s bankruptcy proceedings initiated just before judgment was about to be entered.

On the evening of November 28, 2018, a jury in Santa Clara Superior Court returned a verdict in favor of ASML on all of its five claims against XTAL, awarding $223 million on the trade secrets claim, $135 million for inducing former employees to breach their contracts with ASML, $169 million for aiding and abetting former employees to breach their duty of loyalty to ASML, and $1.2 million in forensic investigation costs for breach of California’s computer fraud statute (Penal Code Section 502). See a copy of the verdict forms here. The jury also found that XTAL’s conduct as to all counts was malicious, which entitles ASML to an award of punitive damages on all counts and attorneys’ fees on its Penal Code and trade secret claims. The Court will determine these amounts in post-trial proceedings. ASML’s Bartko litigation team was led by Patrick M. Ryan with a team of other dedicated lawyers, including Stephen C. Steinberg, Sean R. McTigue, Brian A. E. Smith, C. Griffith Towle, Andrew H. Winetroub, Alden K. Lee, Joseph J. Fraresso, and Rishi Gupta. Patrick M. Ryan reacts to the jury’s verdict, stating: “I am gratified by the jury’s powerful verdict in favor of ASML, which will help secure and protect the tremendous hard work and innovation of ASML and its brilliant and dedicated employees.”
