Speaking from a U.S. perspective as part of a broader series of international panel discussions, Giovanni explained how the American legal system draws a clear separation between judges and prosecutors, both structurally, as they operate within different branches of government, and practically, through distinct appointment, election, and hiring processes, with separate oversight and disciplinary procedures. He also highlighted how the legitimacy of the U.S. system relies not solely on career separation, but on a dense framework of ethical rules, recusal obligations, transparency requirements, and institutional norms, consolidated traditions and practices designed to safeguard independence and impartiality of judges and prosecutors, both at the federal and state level.
